Exclusion of Liability

The HDS - Federal Association of the German Footwear and Leather Goods Industry shall hereinafter be referred to as the “Website Operator”.

1. Content of the website

The Website Operator shall accept no liability for the information provided being up-to-date, accurate, complete or of good quality. Liability claims against the Website Operator which refer to material or non-material damages which have been caused by the use of or failure to use the information provided and/or the use of or failure to use erroneous and incomplete information are excluded, provided that no evidence can be provided of wilful intent or gross negligence on the part of the author.

All offers are non-binding and subject to change. The Website Operator expressly reserves the right to alter, extend or delete parts of pages or the entire website without a separate announcement, or to temporarily or permanently discontinue the publication.

2. References and Links

In the case of direct or indirect links to external websites ("links"), which lie beyond the Website Operator’s responsibility, the Website Operator shall only be liable if it is aware of the contents and it would have been technically possible and reasonable for it to prevent use in the case of illegal contents.

The Website Operator hereby expressly declares that, at the time at which the pages were linked, no illegal contents could be identified on the pages to be linked. The Website Operator has no influence on the current and future layout, the contents or the authorship of the linked pages. For this reason, he hereby expressly distances himself from all contents of linked pages which have been altered after the pages were linked. This statement shall apply to all links and references within our own website, as well as to entries by third parties in guest books, discussion forums and mailing lists set up by the Website Operator. The provider of the linked site alone is liable for illegal, erroneous or incomplete contents and, in particular, for damages which arise from the use of or failure to use such information provided, not the provider who merely provides the link to the relevant publication.

3. Copyright and Trade Mark Law

The Website Operator endeavours to observe the copyrights of the graphics, sound recordings, video sequences and texts used in all the publications, to use graphics, sound recordings, video sequences and texts produced by the Website Operator itself or to fall back on graphics, sound recordings, video sequences and texts in the public domain.
All the brands and trademarks mentioned in the website and, if applicable, protected by third parties are subject to the provisions of the applicable trade mark law and the property rights of the respective registered owner without restriction. It may not be inferred that the brand is not protected by third party rights on the basis of its mere mention!

The copyright for published items created by the Website Operator itself is retained by the Website Operator alone. The replication or use of such graphics, sound recordings, video sequences and texts in other electronic or printed publications is not permitted without the express agreement of the Website Operator.

4. Data Protection

If it is possible to enter personal and business data in the website (email addresses, names, address), the disclosure of this data on the part of the user takes place on a strictly voluntary basis. The use of all the services offered is – as far as this is technically possible and reasonable – also permitted without such data being given or through the provision of anonymous data or a pseudonym.
